Agreement to these terms

These Terms of Service ("Terms") are a binding agreement between you (the "Customer", "you") and eHub Co. Ltd ("eHub", "we", "us"), the company that operates the eHub SMS platform at sms.ehub.co.tz. By creating an account, sending a message, or otherwise using the service, you accept these Terms. If you are using eHub SMS on behalf of a business, you confirm you are authorised to bind that business.

If you do not agree with these Terms, please do not use the service.

The service

eHub SMS is a bulk messaging platform that lets you send SMS to recipients in Tanzania and beyond, register custom Sender IDs, manage contacts, and integrate via our REST API. The service is provided on a prepaid, pay-as-you-go basis. We may add, change, or remove features over time to improve the platform.

Eligibility

eHub SMS is a business tool. To use it you must be at least 18 years old and capable of forming a binding contract. You must provide accurate registration information and keep it up to date. Accounts found to be registered with false information may be suspended.

Your account

• You are responsible for keeping your password and API keys secret. We strongly recommend enabling two-factor authentication.
• You are responsible for all activity that happens under your account, including all SMS sent and all charges incurred — whether by you, your team, or anyone using your credentials.
• Notify us immediately at support@ehub.co.tz if you believe your account has been accessed without your permission.
• One person or business may not operate multiple accounts to evade limits, suspensions, or pricing tiers.

Acceptable use

Your use of eHub SMS is governed by our Acceptable Use Policy, which forms part of these Terms. In short: only message people who have agreed to hear from you, never send unlawful, fraudulent, or harmful content, and respect opt-out requests. Breaching the Acceptable Use Policy is a breach of these Terms.

Sender IDs and message content

• Custom Sender IDs are subject to review and approval before activation. We may reject or revoke a Sender ID that impersonates another brand, is misleading, or breaches TCRA (Tanzania Communications Regulatory Authority) guidelines.
• You are solely responsible for the content of every message you send and for ensuring it complies with applicable Tanzanian law.
• We do not pre-screen message content, but we may inspect, hold, or block messages we reasonably believe are unlawful, fraudulent, or abusive.

Credits, payments and refunds

Prepaid credits

SMS are paid for in advance by purchasing credits. Each message consumes credits based on the pricing tier in effect at the time and the length/encoding of the message.

No expiry

Credits do not expire while your account remains active. There are no monthly fees.

Refunds

Credits already consumed (messages submitted for delivery) are non-refundable. Unused credit balances are generally non-refundable, but if you believe you were charged in error, contact support@ehub.co.tz and we'll review it fairly.

Delivery

A message that is accepted and submitted to the mobile networks is treated as delivered for billing purposes. We are not responsible for messages that fail because a number is invalid, switched off, or blocked by the carrier.

Pricing changes

We may change pricing for future purchases. Changes never affect credits you have already bought.

Availability and support

We work hard to keep eHub SMS available and fast, but the service is provided on an "as available" basis. We may carry out maintenance, and message delivery depends on third-party mobile networks that are outside our control. We do not guarantee uninterrupted or error-free service unless a separate written service-level agreement says otherwise. Support is available by email at support@ehub.co.tz.

Suspension and termination

We may suspend or terminate your account, with or without notice, if:

• you breach these Terms or the Acceptable Use Policy;
• we are required to by law or by a regulator such as TCRA;
• your activity threatens the security, stability, or reputation of the platform or the networks we rely on; or
• we reasonably suspect fraud or abuse.

You may close your account at any time from your settings or by emailing us. On termination, your right to use the service stops immediately. Sections that by their nature should survive (such as payment obligations, intellectual property, disclaimers, and limitation of liability) will continue to apply.

Intellectual property

The eHub SMS platform, its software, design, and branding belong to eHub Co. Ltd. We grant you a limited, non-exclusive, non-transferable right to use the service while these Terms are in force. You keep ownership of your own content — your messages, contacts, and data. You grant us only the limited rights needed to operate the service and deliver your messages.

Disclaimers and limitation of liability

Where liability cannot be excluded, our total liability to you for any claim is limited to the amount you paid us for the service in the three (3) months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

You agree to indemnify and hold eHub Co. Ltd harmless from claims, damages, and costs arising from your messages, your breach of these Terms, or your violation of any law or third-party right.

Governing law

These Terms are governed by the laws of the United Republic of Tanzania. Any dispute that cannot be resolved amicably will be subject to the exclusive jurisdiction of the courts of Tanzania.

Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the date at the top of this page and notify account holders by email at least seven days before they take effect. Continuing to use eHub SMS after a change means you accept the updated Terms.
